City victorious in legal action against Doctor John’s, Inc.

The St. Louis County Circuit Court Judge Mary Elizabeth Ott affirmed the temporary restraining order against Dr. John’s Lingerie Boutique by imposing a permanent injunction on Dec. 3, incurring a $157,500 fine. The city’s attorney, David Streubel, said that a $1,500 daily fine will continue to accrue.

The St. Louis County Circuit Court Judge Mary Elizabeth Ott affirmed the temporary restraining order against Dr. John’s Lingerie Boutique by imposing a permanent injunction on Dec. 3, incurring a $157,500 fine. The Manchester city attorney, David Streubel, said that a $1,500 daily fine will continue to accrue.

The action occurred after the city of Manchester filed legal action against Doctor John’s Inc. seeking a court order requiring the Dr. John’s store located at 14463 Manchester Road to comply with the city’s zoning code and the store’s agreed-upon limited use as an apparel and accessories store. The fine is for violating the agreement. Although no official notice was given to the city, the windows are covered in blackout paper with a “for lease” sign. The business closed to the public a few days before Christmas.

Doctor Johns, Inc. filed a federal lawsuit against the city of Manchester this fall. As previously reported, owner John Haltom said “The city just said we had to take out things that weren’t apparel or accessories. They don’t say specifically what that means. I’m not going to guess and play their game. They cannot tell me what I can and can’t sell. Then, they are censoring [my business] and they will be in a lot of trouble. They know they cannot [legally] do that.”

Neither party responded to West Newsmagazine’s request for an interview.
